font-size: 12pt;\">Uma das principais novidades \u00e9 a possibilidade de utiliza\u00e7\u00e3o de <strong>pr\u00e9-teste ou teste passivo de alcoolemia<\/strong> durante a abordagem.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">O equipamento poder\u00e1 indicar a presen\u00e7a de \u00e1lcool, mas o resultado ter\u00e1 car\u00e1ter de <strong>triagem<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>Um resultado positivo no pr\u00e9-teste, sozinho, n\u00e3o ser\u00e1 suficiente para multar o motorista ou comprovar que ele dirigia sob influ\u00eancia de \u00e1lcool.<\/strong> Ser\u00e1 necess\u00e1rio seguir os procedimentos previstos na regulamenta\u00e7\u00e3o para confirmar a situa\u00e7\u00e3o.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">O tradicional <strong>baf\u00f4metro continua sendo utilizado<\/strong> nas fiscaliza\u00e7\u00f5es.<\/span><\/p>\n<h2><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><strong>Teste para detectar drogas<\/strong><\/span><\/h2>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A resolu\u00e7\u00e3o tamb\u00e9m regulamenta o uso de equipamentos capazes de identificar <strong>outras subst\u00e2ncias psicoativas<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Esses aparelhos dever\u00e3o ser certificados pelo Sistema Brasileiro de Avalia\u00e7\u00e3o da Conformidade (SBAC), por organismo acreditado pelo Inmetro.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">O resultado ser\u00e1 <strong>qualitativo<\/strong>, indicando a presen\u00e7a ou n\u00e3o da subst\u00e2ncia, e n\u00e3o a sua concentra\u00e7\u00e3o.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A fiscaliza\u00e7\u00e3o dever\u00e1 considerar tamb\u00e9m os <strong>sinais apresentados pelo motorista<\/strong>, especialmente altera\u00e7\u00f5es da capacidade psicomotora.<\/span><\/p>\n<h2><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><strong>O que s\u00e3o subst\u00e2ncias psicoativas?<\/strong><\/span><\/h2>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">S\u00e3o subst\u00e2ncias capazes de <strong>alterar o funcionamento do sistema nervoso central<\/strong> e comprometer a capacidade do motorista de conduzir o ve\u00edculo com seguran\u00e7a.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A resolu\u00e7\u00e3o n\u00e3o estabelece um \u00fanico modelo de equipamento e tamb\u00e9m n\u00e3o determina que a simples identifica\u00e7\u00e3o de vest\u00edgios de uma subst\u00e2ncia seja suficiente, isoladamente, para caracterizar a infra\u00e7\u00e3o.<\/span><\/p>\n<h2><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><strong>Restos de \u00e1lcool podem interferir no teste<\/strong><\/span><\/h2>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A nova regulamenta\u00e7\u00e3o prev\u00ea procedimentos para situa\u00e7\u00f5es em que exista <strong>\u00e1lcool temporariamente presente na boca<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Isso pode ocorrer ap\u00f3s o consumo de produtos como <strong>bombons com licor, enxaguantes bucais e determinados alimentos<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Sempre que poss\u00edvel, motoristas envolvidos em <strong>sinistros de tr\u00e2nsito<\/strong> dever\u00e3o ser submetidos \u00e0 fiscaliza\u00e7\u00e3o.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Em acidentes que resultem em <strong>morte<\/strong>, dever\u00e1 ser realizado exame para verificar a presen\u00e7a de \u00e1lcool ou outras subst\u00e2ncias psicoativas.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">As informa\u00e7\u00f5es obtidas tamb\u00e9m poder\u00e3o ser utilizadas no planejamento de a\u00e7\u00f5es e pol\u00edticas p\u00fablicas de seguran\u00e7a no tr\u00e2nsito.<\/span><\/p>\n<h2><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><strong>Recusar o baf\u00f4metro continua sendo infra\u00e7\u00e3o<\/strong><\/span><\/h2>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A nova resolu\u00e7\u00e3o <strong>n\u00e3o criou novas multas nem alterou as penalidades previstas no C\u00f3digo de Tr\u00e2nsito Brasileiro (CTB)<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Quem se recusa a realizar o teste do baf\u00f4metro durante uma fiscaliza\u00e7\u00e3o da Lei Seca continua sujeito a:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>Multa de R$ 2.934,70<\/strong>;<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>Suspens\u00e3o da CNH por 12 meses<\/strong>;<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Possibilidade de <strong>recolhimento da CNH<\/strong>;<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\"><strong>Reten\u00e7\u00e3o do ve\u00edculo<\/strong> at\u00e9 que um motorista habilitado possa assumir a dire\u00e7\u00e3o;<\/span><\/li>\n<li><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Em caso de reincid\u00eancia em at\u00e9 12 meses, <strong>multa de R$ 5.869,40<\/strong>.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">A regulamenta\u00e7\u00e3o tamb\u00e9m prev\u00ea a atualiza\u00e7\u00e3o do Manual Brasileiro de Fiscaliza\u00e7\u00e3o de Tr\u00e2nsito (MBFT) para padronizar os procedimentos em situa\u00e7\u00f5es de recusa.<\/span><\/p>\n<h2><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><strong>Quando as novas regras ser\u00e3o aplicadas?<\/strong><\/span><\/h2>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Embora a resolu\u00e7\u00e3o tenha sido publicada nesta ter\u00e7a-feira (18), <strong>a nova fiscaliza\u00e7\u00e3o com os equipamentos para detec\u00e7\u00e3o de subst\u00e2ncias psicoativas depender\u00e1 da certifica\u00e7\u00e3o dos aparelhos e dos procedimentos<\/strong>.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">Al\u00e9m disso, as mudan\u00e7as relacionadas \u00e0s fichas de fiscaliza\u00e7\u00e3o e aos c\u00f3digos de enquadramento das infra\u00e7\u00f5es ter\u00e3o <strong>prazo de 60 dias<\/strong> para implementa\u00e7\u00e3o.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 12pt;\">At\u00e9 que essa adapta\u00e7\u00e3o seja conclu\u00edda, os \u00f3rg\u00e3os do Sistema Nacional de Tr\u00e2nsito continuar\u00e3o utilizando os c\u00f3digos atualmente vigentes.<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;
