O magistrado destacou que parlamentares s\u00f3 podem ser afastados em situa\u00e7\u00f5es espec\u00edficas, o que levanta d\u00favidas sobre a legalidade da medida adotada.<\/span><\/p>\n<p data-start=\"957\" data-end=\"1203\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Outro fator considerado foi o <strong data-start=\"987\" data-end=\"1033\">poss\u00edvel cerceamento de defesa do prefeito<\/strong>, com questionamentos sobre o prazo concedido para apresenta\u00e7\u00e3o da defesa pr\u00e9via. Para a Justi\u00e7a, h\u00e1 risco de que o direito de defesa n\u00e3o tenha sido plenamente garantido.<\/span><\/p>\n<p data-start=\"1205\" data-end=\"1464\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">O juiz tamb\u00e9m levou em conta o chamado <strong data-start=\"1244\" data-end=\"1266\">\u201cperigo na demora\u201d<\/strong>, j\u00e1 que a sess\u00e3o estava marcada para ocorrer nesta quinta. <strong data-start=\"1326\" data-end=\"1412\">Sem a suspens\u00e3o, o prefeito poderia ser cassado antes da an\u00e1lise judicial completa<\/strong>, o que poderia causar dano irrevers\u00edvel ao mandato.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"585\" data-end=\"867\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif; font-size: 10pt;\"><strong><span style=\"color: #808080; font-family: tahoma, arial, helvetica, sans-serif;\">= continua ap\u00f3s a publicidade =<\/span><\/strong><\/span><\/p>\n<div id=\"63534-1\"><script src=\"\/\/ads.themoneytizer.com\/s\/gen.js?type=1\"><\/script><script src=\"\/\/ads.themoneytizer.com\/s\/requestform.js?siteId=63534&amp;formatId=1\"><\/script><\/div>\n<p data-start=\"1466\" data-end=\"1710\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Com a decis\u00e3o, a C\u00e2mara dever\u00e1 ser notificada imediatamente e ter\u00e1 que <strong data-start=\"1537\" data-end=\"1581\">enviar a \u00edntegra do processo legislativo<\/strong> para an\u00e1lise do Judici\u00e1rio. Outro processo relacionado ao caso, que tramitava na 2\u00aa Vara, ser\u00e1 reunido para julgamento conjunto.<\/span><\/p>\n<p data-start=\"1712\" data-end=\"1945\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">No pedido apresentado \u00e0 Justi\u00e7a, a defesa de <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Fernando Lubrechet<\/span><\/span> argumenta que o procedimento apresenta <strong data-start=\"1834\" data-end=\"1869\">\u201cv\u00edcios processuais insan\u00e1veis\u201d<\/strong>, tese que foi considerada relevante pelo magistrado neste primeiro momento.<\/span><\/p>\n<p data-start=\"1947\" data-end=\"2202\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">A Comiss\u00e3o Processante foi instaurada ap\u00f3s uma <strong data-start=\"1994\" data-end=\"2045\">fraude banc\u00e1ria registrada em fevereiro de 2025<\/strong>, quando criminosos enviaram um e-mail falso sobre o pagamento do vale-alimenta\u00e7\u00e3o de servidores municipais, resultando no desvio de cerca de R$ 2,1 milh\u00f5es.<\/span><\/p>\n<p data-start=\"2204\" data-end=\"2433\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">De acordo com a Prefeitura de <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Pirassununga<\/span><\/span>, foram adotadas medidas ap\u00f3s a identifica\u00e7\u00e3o do golpe, como <strong data-start=\"2332\" data-end=\"2432\">novo pagamento aos servidores, registro de boletim de ocorr\u00eancia e bloqueio judicial dos valores<\/strong>.<\/span><\/p>\n<p data-start=\"2435\" data-end=\"2608\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">A defesa do prefeito afirma ainda que <strong data-start=\"2473\" data-end=\"2500\">n\u00e3o h\u00e1 ind\u00edcios de dolo<\/strong> por parte de <span class=\"hover:entity-accent entity-underline inline cursor-pointer align-baseline\"><span class=\"whitespace-normal\">Fernando Lubrechet<\/span><\/span>, segundo as investiga\u00e7\u00f5es conduzidas pela Pol\u00edcia Civil.<\/span><\/p>\n<p data-start=\"2610\" data-end=\"2761\" data-is-last-node=\"\" data-is-only-node=\"\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Com a liminar em vigor, <strong data-start=\"2634\" data-end=\"2701\">o processo de cassa\u00e7\u00e3o fica suspenso e sem previs\u00e3o de retomada<\/strong>.
